One person either the wife or husband needs to go to the office of the additional Divisional Magistrate during the morning session of any working day in the jurisdiction of either wife or the husband. Application Charges for Informing about the intended marriage

The first step of the court marriage procedure is to inform the marriage officer of the district about your intention to marry. You have to do this by filling up an application form for the court marriage which is mentioned in Schedule II of the Act that can also be downloaded online. You have to submit the application form 30 days before the marriage date to the district office where either of the participants resides.

Displaying the Notice

The district marriage registrar will display the notice at a leading place at his office for 30 days. If it is deemed illegal under the Act then anyone can object to the marriage within this period and the prescribed eligibility conditions. According to Section 7 of the Special Marriage Act, any person having an objection to the marriage intended can raise it within 30 days from the publication of the notice.

Objections to Marriage

On the receipt of any objection, the marriage registrar checks the validity of the marriage on the objection based. On being reasonably satisfied with the validity of the objection then the registrar can end the court marriage process. After that parties may appeal to the concerned district court against the order of the marriage registrar. If there is no valid objection then the officer can proceed with the procedure of court marriage, according to the court marriage rules.

Day of Marriage

According to section 12 of the Special Marriage Act, The bride, groom, and three witnesses are required to sign a declaration form in the presence of the marriage registrar at the registrar’s office. The statement would state that the parties are proceeding with the court marriage with their consent.

Court marriage certificate

Once all the formalities are completed after that the marriage registrar inserts all the details of the court marriage in the court marriage certificate according to the provisions which are given under Schedule IV of the Special Marriage Act. The marriage certificate will be issued within 15 to 30 days. The entire court marriage process usually takes 30 to 60 days to complete the process.

  • Application Fee for Registration: Rs.100/-

  • Special Marriage Act: Rs.150/-

Documents Required for Court Marriage

  • Name and signature of the bride and groom along with the form.

  • The minimum age of the bride should be 18 years and the bridegroom should be 21 years who apply for the marriage certificate.

  • Proof of temple marriage from the priest.

  • Any age proof like; a ration card or any other id proof.

  • A copy of the marriage invitation along with the marriage photo is pasted on a piece of paper.

  • Witnesses from both sides.

You can also apply for Court Marriage in Delhi by following some steps:

  • Visit the online website and fill out the application with all your details.

  • After filling out the application obtain a printout of the form and the acknowledgment receipt on which you will obtain a number.

  • Post the printed application form to the particular officer who deals with it through registered post.

  • The applied individual can even check the status of the application after posting it with all the necessary documents.

  • After verifying, the officer will allot 10-digit numbers and once your documents are done then you meet the officer to finally register your marriage.

Inter-Community Marriage

If your marriage is an inter-caste or an inter-community then you can obtain your marriage Certificate under the Special Marriage Act. You should apply 30 days before the marriage and then can obtain that your marriage is certified. Some documents needed the register your marriage which is given following:

  • Receipt of the fee of Rs.15/- which is deposited with the cashier of the District

  • Age-proof of both parties

  • Current marital status

  • Confirmation that none of the parties are related to each other

  • Two Passport size photographs of both parties and which are attested by a Gazette Officer.
