The due date for DIR-3 KYC Extends to 15th October 2022

On 28th September 2022 Ministry of Corporate Affairs (MCA) extended the due date for e-filling DIR-3 KYC and Web form DIR-3 KYC WEB from 30th September 2022 to 15th October 2022 without any fees. 

WHAT IS DIR-3 KYC FORM?

Any person who is intending to become a director should have Director Identification Number(DIN) and can make an application under eForm DIR-3 for allotment of DIN which is a one-time process. But, the Ministry of Corporate Affairs(MCA) introduced a form for the person who has DIN to update their KYC details annually in eForm DIR-3 KYC.

In other words, every director should file the DIR-3 KYC form every year before 30th September. 

WHO IS REQUIRED TO FILE DIR-3 KYC and DIR-3 KYC WEB?

For DIR-3KYC-

  • Any person who has been allotted “Director Identification Number (DIN/DPIN)” on or before 31st March of the financial year. 

  • Any director whose DIN status is ‘Approved’

For DIR-3 KYC WEB-

Any DIN holder who has already submitted eForm DIR-3 KYC in any of the previous financial years and who does not require an update in any of his KYC details as submitted may perform his annual KYC by accessing the DIR-3 KYC web service.

PROCESS OF FILING DIR-3 KYC OR DIR -3 KYC WEB

Both the form can file through login to the www.mca.gov.in –

  • For login enter V3 Business User ID, if login is not available then register to create a login ID.

  • After login, click on > my application > company e-filing > DIN related filing > Form DIR-3 KYC or DIR-3 KYC WEB

  • Then fill in the required details by entering DIN and generating OTP

  • Verify PAN

  • Mention OTP received on the mobile number and Email ID

  • Attach the required documents

  • After e-certifying by a professional(CA/CS/CMA), SRN will generate. Download the form for DSC verification.

  • DIN holders and professionals (CA/CS/CMA) who certified the form should digitally sign and then upload the pdf. 

DOCUMENTS REQUIRED FOR FILING DIR-3 KYC

  • Proof of Permanent Address

  • Copy of Aadhar Card

  • Copy of Passport

  • Proof of Present Address

  • Permanent Account Number(PAN)

  • Voter ID

  • Driving License 

  • Personal Mobile & Email ID 

FEES FOR FILING DIR-3 KYC OR DIR-3 KYC WEB

There is no fee for filing DIR-3 KYC or DIR-3 KYC WEB before the due date. But after the due date, a fee of Rs.5000 shall be payable. 

IF FAILS TO FILE DIR-3 KYC BEFORE THE DUE DATE?  

If the DIN holder does not file his annual KYC within the due date of each financial year, such DIN shall be marked as ‘Deactivated due to non-filing of DIR-3 KYC’ and shall remain in such Deactivated status until KYC is done with a fee of Rs.5000.

IMPORTANT POINTS FOR FILING DIR-3 KYC

  • Form DIR-3 KYC should be certified by in whole time practice Chartered Accountant, Cost Accountant, or Company Secretary. 

  • If the KYC is done in one financial year, it NEED NOT be done again in the same financial year.

  • In the case of Citizens of India, the PAN mentioned in the DSC is verified with the PAN mentioned in the form.

  • In the case of foreign nationals, the name in the DSC affixed should match the name entered in the form. DSCs affixed on the form should be duly registered on the MCA portal.
