What is the DIR-3 KYC Form?

The Central Government issues individuals who want to become Directors in Corporations and/or Designated Partners in Limited Liability Partnerships ("LLP") with a DIN, an eight-digit unique number. Every person with a Director Identification Number ("DIN") and an electronic form (the "Form") must submit it. This includes residents, non-residents, and foreign nationals.

Deadline: This form must be submitted annually to the MCA.

What's in the Form:

In this DIR-3 KYC form, the DIN holder discloses all of his or her personal information, including full name, citizenship, residential status, date of birth, gender, residential address, mobile number, email address, along with the newest copies of his or her identity and address proof that have been duly attested by the appropriate government agencies or working professionals.

What is the Purpose of Form DIR-3 KYC?

Within thirty days of receiving notification that the Director Identification Number has been approved, each Director must advise all companies in which they hold a directorship as well as the DIN assigned to them in Form DIR-3B. Similar to this, a company's manager and secretary must provide the company with their PAN (Permanent Account Number). Within 15 days of receiving notification, the Company must submit Form DIR-3C to the Registrar with additional information about the DIN of Directors.

Different Types of DIR-3 KYC

  • The web services are made available to DIN holders who have already filed the e-Form DIR-3 KYC in the previous Financial Year and who also don't need to update their KYC details and can perform yearly KYC updation.

  • The DIN holder filing the Director's KYC details in the starting period as per the MCA should file the KYC details through the e-Form DIR-3 KYC & the web services access is not available to the individual; also, the holder needs to update the KYC details through the e-Form DIR-3 KYC if update is required. For the update, there is no access to web services.

Who Can File e-Form DIR-3 KYC?

According to a recent MCA notice, Directors who meet the following criteria must submit their KYC information to the Ministry of Corporate Affairs: 

  • Any Director whose DIN was approved by the 31st of March 2018 must do so. The following procedure is also required of disqualified directors: 

  • Each director who has been assigned a DIN on or before the end of the financial year and whose Director Identification Number has been approved shall file the DIR-3 KYC Form before September 30 of the following financial year. For example, Directors Partner Identification Number (DPIN) holders and directors assigned DPIN by March 31, 2023, must submit the e-Form DIR-3 KYC by September 30, 2023.

Important Point to Know Before Filing the e-Form DIR-3 KYC

  • Each Director must include their individual cell phone number and email address when submitting the e-form. This contact information (phone number and email) will be validated by an OTP;

  • The Director must use their digital signature when submitting the DIR-3 KYC Form. 

  • Fill in the complete information. 

  • The e-form should be approved by a practicing CA, CS, or cost & management accountant.

Documents Required to File DIR-3 KYC Form

You'll need the following paperwork to submit your DIR 3 - KYC form:

  • Information about nationality and citizenship, including gender and birthdate.

  • PAN, or Permanent Account Number.

  • Voter identification card.

  • Passport (required for foreign nationals who hold DINs).

  • A driving permit.

  • The Aadhar card.

  • A personal email and mobile number.

  • Address at home.

In addition to the items listed above, kindly have the following items available:

  • The applicant's digital signature on the application.

  • Certification of the aforementioned documents by Practicing Professionals such Cost Accountants, CAs, or CSs. Documents for foreign nationals must be attested by the designated authorities.

  • The applicant must submit a declaration that has been properly witnessed by licensed specialists.

Process of Filing DIR-3 KYC Form

Step 1: Download the form

• Download the form from the MCA official website.

Step 2: DIN details

• Directors to fill in the DIN in the form, status showing ‘Approved’

Step 3: Required Details 

1. Name and any pertinent credentials

The candidate must include name as well as his father's name. Things to keep in mind :

  • The director must put his name as it appears on his PAN.

  • The PAN database will be used to verify the address provided in the form.

  • Acronyms, short forms, and single alphabets are not accepted.

1. Nationality 

Directors must disclose their nationality; those who are of foreign descent must disclose the race listed on their passport.

2. Age Verification

The format for a director's date of birth (DOB) is DD/MM/YYYY. Age declaration is required since applicants under the legal age of 18 are not permitted to submit this application.

3. Address

Each director is required to indicate his or her permanent residential address and to attach documentation of that address. 

Note: A foreign PIN code can only be provided if the state is "NA" in the state selection.

Step 4: Authentication of e-Form

The e-Form must be validated, which means it must be digitally signed by a Chartered Accountant/Cost Accountant or a Company Secretary who is currently engaged in their line of work. It is essential and cannot be avoided to provide the practicing professional's contact information as well as their digital signature.

Step 5: SRN Generation

After the e-Form DIR-3 KYC has been properly filed, the user is given an SRN for use in future communications with the MCA.

Step 6: Email communication

On his personal email ID, the applicant will receive an email confirming the receipt of the form.

Due Date of Filing DIR-3 KYC Form

According to Rule 12A of the Companies (Appointment and Qualification of Directors) Rules, 2014, DIN holders who were assigned a DIN as of the 31st March of a financial year must submit Form DIR-3 KYC by September 30th of the following fiscal year.
